We invite you to print out these Terms & Conditions, or we can e-mail these to you on request. Please request the "Terms & Conditions" from our Customer Service Centre.

YOUR STATUTORY RIGHTS ARE NOT AFFECTED BY OUR TERMS AND CONDITIONS.

Specifications on items may change without prior notice. Any returns must be made using secure post at your own cost and be in a returned in original packaging, unused/unopened/ unbuilt state.
Please note orders being returned with a 'Free Shipping' method, will incur a Flat Fee of £6 in UK and £12 from Europe, to recover the original shipping costs.


We accept no liability (to the fullest extent allowed by law) for the accuracy of information contained on the website or related adverts, which may contain technical inaccuracies or typographical errors including information via email. However, this provision does not affect your statutory rights and remedies.

These terms & conditions contain the whole of our agreement relating to your purchase, together with our website prices and contact details. They cannot be varied except where in writing and signed by a Director of R&K Enterprise Ltd.

Orders and availability

Orders are normally processed despatched within 24hrs of receipt of order or same day if placed before 3pm, but please allow up to 1-5 working days for delivery due to the nature of Royal Mail and International Post, Next Day Special Delivery and UPS normally arrive within 24Hrs in UK, we will notify you via email when you order ships. Please note AIR MAIL can take between 5-10 working days to arrive in certain countries.

Items on the site may be indicated as in stock but may not be available for immediate despatch, as the nature of supply for these items can be patchy from time to time and may be supplied from more than one origin. Most orders are completed and delivered within 1-2 days (postal during normally Monday to Friday Only).

If at any time you require an order refunded it will be done straight away. If using PayPal this refund can take up to 3-5 working days to show, but normally quicker. Orders placed after 3pm will be processed the following day.

Please note that your order may be part shipped should any item be out of stock. In the unlikely event that any of the items you have ordered are out of stock or we had a system error showing the item in stock, when actual physical stock is wrong, we will send the remaining items out as soon as they arrive and we will cover the extra postage. In these circumstances, we will do our best to keep you informed and provide any options.

Order Confirmation

You will receive an order confirmation email as soon as you have placed an order. Please keep this email as we may ask you for information from it in any correspondence. If you do not receive this email please contact [email protected] so that we may investigate and confirm that your order has been placed successfully.

Amending Your Order

If you wish to make any other changes to your order, such as delivery address or quantity of goods, please email [email protected], or phone while in open hours, You need to email as soon as possible. If the item is already packed for shipping, we will try and do our best to accommodate.

Order Status

To view the status of your order, please sign-in to the Robotbirds.co.uk website using your username and password, and select the option.

Right to cancel your order

If you need a refund on your order and it has already been processed and posted or is an order under ‘Special Order’ from our supplier or is ready to deliver, any monies refunded can take up to 5-10 days transaction times. Please use the RMA system online to confirm the return of the goods. ( Note goods should not be used or opened in such a way that they cannot be re-sold )

1 DEFINITIONS

1.1 "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;

1.2 "Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;

1.3 "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;

1.4 "Goods" means the articles that the Buyer agrees to buy from the Seller;

1.5 "Seller" means R&K Enterprise Ltd, 884 Plymouth Road, Slough Trading Estate, Slough SL1 4LP that owns and operates www.Robotbirds.co.uk.co.uk

1.6 "Terms and Conditions" means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller;

1.7 "Website" means www.Robotbirds.co.uk.co.uk

2 CONDITIONS

2.1 Nothing in these Terms and Conditions shall affect the Buyers statutory rights as a Consumer.

2.2 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

2.3 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyers acceptance of these Terms and Conditions.

2.4 Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

2.5 Any complaints should be addressed to the Sellers address stated in clause 1.5.

3 ORDERING

3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

3.2 Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 30 days.

3.3 When making an order through the Website, the technical steps the Buyer needs to take to complete the order process are to add a product to the basket by clicking ‘add to basket and following the instructions on screen to proceed through the checkout pages, supplying the appropriate details along the way. A confirmation email will be sent to the customer of the order.

4 PRICE AND PAYMENT

4.1 The price of the Goods shall be that stipulated on the Website. The price is inclusive of VAT. The price excludes delivery charges which can be seen in the basket area of the website.

4.2 The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyers shopping cart prior to confirming the order.

4.3 After the order is received the Seller shall confirm by email the details, description and price for the Goods together with information on the right to cancel if the Buyer is a Consumer.

4.4 Payment of the price plus VAT and delivery charges must be made in full before dispatch of the Goods.

4.4 In the case of consumer sales, payment of the price plus VAT and delivery charges must be made in full before dispatch of the Goods.

4.5 We only accept UK GBP Sterling as payment. The price quoted in Euros / USD is a guide price only, and is dependent on the current exchange rates, made available to our online system.

5 RIGHTS OF SELLER

5.1 The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.

5.2 The Seller reserves the right to withdraw any goods from the Website at any time.

5.3 The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

6 AGE OF CONSENT

6.1 Where Goods may only be purchased by persons of a certain age the Buyer will be asked when placing an order to declare that they are of the appropriate legal age to purchase the Goods.

6.2 If the Seller discovers that the Buyer is not legally entitled to order certain Goods, the Seller shall be entitled to cancel the order immediately, without notice.

7 WARRANTY

The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller. Except where the Buyer is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability or condition of the Goods, whether implied by Statute, common law or otherwise are excluded, and the Buyer is satisfied as to the suitability of the Goods for the Buyers purpose.

Ready to Fly models, once checked and confirmed by the consumer, do not hold the same warranty. As we selling flying models and the nature of consumers using their own equipment to control, operate and power the models, alot of different factors can cause eventual failure. We will of course look into every case, if a warranty claim arrises.

Second items are not covered with the same warranty, as new items, and are ‘Sold as Seen’.

We will not cover crash damage as a result of failing electronics or faulty parts. The item in question will covered and we may seek advise from an independant to verify the warranty claim. We do have the right to inspect the goods, at the time of the warranty claim.

8 DELIVERY

8.1 Goods supplied within the UK will normally be delivered within 48 Hrs of acceptance of order. We always endeavour to deliver next day for all orders placed during Mon-Friday. Please allow up to 7 days for delivery.

8.1.1 Goods ordered under ‘Special Order’, please allow up to 14 days for delivery.

8.2 We do deliver out side the UK and into the REST of the World.

8.3 Where a specific delivery date has been agreed, and where this delivery date cannot be met, the Buyer will be notified and given the opportunity to agree a new delivery date or receive a full refund.

8.4 The Seller shall use its reasonable endeavors to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

8.5 Delivery of the Goods shall be made to the Buyers address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

8.6 The seller does not accept any liability for the loss or damage of goods lost in transit via the buyers chosen delivery method. Some services offer insurances which are detailed under our shipping section

 

9 CANCELLATION, RETURN and Refunds

9.1 The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller by email [email protected] or telephone (tel. 01753-694171) or through the online RMA system, within 14 days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.

9.2 If you are a consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing the Seller by email [email protected] or telephone 01753-694171 within 14 working days of receipt of the Goods. The right to cancel does not apply to contracts for the supply of software, audio or visual recordings if these have been unsealed by the Consumer.

9.3 Goods must be returned by the Buyer at the Buyers expense and should be adequately insured during the return journey. The Buyer will receive a refund of all monies paid for the Goods (except postal charges) within 30 days of cancellation. If the Buyer fails to return the Goods following cancellation, the Seller shall be entitled to deduct the cost of recovering the Goods from the Buyer.

9.4 Goods to be returned must clearly show the order number obtained from the Seller on the package.

9.5 Where returned Goods are found to be damaged due to the Buyers fault the Buyer will be liable for the cost of remedying such damage.

9.6 Where the Goods are opened and no longer sellable as new, especially parts, the return of parts by the Buyer will incur a 15% re-stocking charge.

9.7 Where the Goods are Kits, and the parts internally on the kit have been opened by the buyer and part built, the refund to the complete kit will incur a 50% restocking charge, as the kit and parts are no longer sellable as new. Kits that have faulty electronics and the consumer is seeking a refund, could have the electronics replaced rather than the kit, as the kit is not at fault.

9.8 Second hand parts are SOLD as SEEN and are not returnable after the consumer has accepted them.

9.9 New Kits that have been requested for professional build will incur a 40% restocking charge as they cannot be sold to a new Buyer as new.

9.10 Where the goods are PRE Built Helicopters ( RTF (ready to Fly) or BTF ( Bind to Fly), the consumer is requested to inspect the goods on delivery. Once the goods have been used, warranty is limited on PRE built Helicopters, due to the nature of these goods as once flown. These goods become opened and second hand. Consumers in alot of cases use there own equipment for operation which can lead to mis-handling, crashing due to pilot error, use of transmitters not purchased through our shop which may develop faults, or power sources that have a poorly soldered connection leading to electric shorting, dry joint sparking. We would advise consumers to check their models prior to each flight to ensure the safety of the model. We will of course look into every case individually, and may seek independant advise.

9.11 Please note orders being returned with a 'Free Shipping' method, will incur a Flat Fee of £6 in UK and £12 from Europe, to recover the original shipping costs.

9.12 Goods returned after 14 Days and the Return has been accepted, the customer will be provided with a credit to same value as money spent at the time of the purchase. Please note it is the managements discretion to the return, replacement or credit provided and each case is considered separately.

10 LIMITATION OF LIABILITY

10.1 This website or any part of it may not be compatible with your browser or computer configuration and we make no warranty that it is. We make no warranty that your access to our website will be uninterrupted, timely or error free and we will not be responsible if we are unable to provide the website for whatever reason.

10.2.1 the goods not matching our description of them;

10.2.2 the goods not being of the quality you would expect; ( Subject to different quality standards from different manufacturers we sell )

10.2.3 the goods not being fit for the purpose for which they are intended; or

10.2.4 us not having the legal right to sell the goods to you.

10.4 Other than the liability we have accepted as described above, we will not be liable for any losses that you suffer as a result of any breach of our agreement except those losses which are a foreseeable consequence of the breach. In particular, as the goods are provided to you as a consumer, we cannot accept responsibility for any losses related to any business of yours such as lost data, lost profits or other business loss that you may incur as a result of any breach of our agreement.

11 WAIVER

No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

12 FORCE MAJEURE

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

13 SEVERANCE

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

14 CHANGES TO TERMS AND CONDITIONS

The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

15 GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
